DUI Third Offense | Second Excessive Offense

A third Driving Under the Influence (DUI) conviction in ten years or a second excessive conviction in five years in Idaho comes with some serious penalties and punishments. These are felony offenses and can land a driver in prison. Felony DUI convictions create lifelong problems that impact employment (many employers have policies against hiring felons), obtaining insurance, and losing some civil liberties.

Prison Sentence

Because it's a felony charge, a conviction can result in a prison sentence. Even if the court chooses not to put you in prison, it is almost certain the sentence will include an extended jail term. The minimum sentence is often 30 days in jail. And, the court can impose up to a ten-year prison sentence.

 
License Suspension

A driver's license suspension for a mandatory minimum of one-year, but depending on the case can last up to five years.

 
Fines

The maximum fine $5,000.
