Your possession of even one pound of marijuana can be enough to prove intent to distribute and a person could face a mandatory minimum fixed sentence and fines of up to $50,000, even though the person does not intend to sell or distribute. For drug crime to be considered trafficking or in possession with intent to deliver sometimes only requires the act of owning a scale or stockpiling for personal use.

Trafficking

Drug trafficking in Idaho is illegal, and any charges related to it are felonies that cannot be removed from your record. Your personal belongings alone may make the difference between a misdemeanor and a felony. Depending on the kind of drug, trafficking carries severe penalties including up to $100,000 in fines, up to life in prison, and potentially a mandatory minimum sentence, not to mention a permanent criminal record.
